Terms of Use
End User License Agreement (EULA) · As of 12 May 2026
Important notice: This agreement is exclusively between you and T. Stephan (licensor) — not between you and Apple. Apple is, however, a third-party beneficiary of this agreement and may enforce it against you.
1. Parties and Subject Matter
This End User License Agreement (EULA) is a legally binding agreement between you and T. Stephan, Kookamp 40, 46354 Südlohn, Germany (hereinafter "Licensor") for the use of the mobile application ExodaFood (hereinafter "App").
By downloading, installing or using the App, you agree to these terms. If you do not agree, do not use the App.
2. License Grant
The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, solely in accordance with the usage rules of the Apple Media Services Terms and Conditions.
The following is not permitted:
- Selling, renting, lending or sublicensing the App
- Reverse engineering, decompiling or extracting the source code
- Creating derivative works or modifying the App
- Circumventing security mechanisms
- Using the App for unlawful or abusive purposes
3. Subscriptions and In-App Purchases
ExodaFood offers a free basic tier and an optional Premium subscription. Purchases and subscriptions are processed exclusively through the Apple App Store. The Licensor is not a party to these payment transactions.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period in Apple Settings (Settings → [Your Name] → Subscriptions).
4. Invitation Codes (Refer-a-Friend)
If you received an invitation code from a friend or from us, you can redeem it here to get one month of ExodaFood Premium for free. No purchase or payment takes place.
The following conditions apply to invitation codes:
- Each code can only be redeemed once.
- Codes are non-transferable and cannot be exchanged for cash or credit.
- A successful referral also earns the referrer one month of Premium for free.
- Abuse (e.g. fake accounts, automated code generation) will result in immediate account suspension and cancellation of all granted benefits.
- Codes are valid for 90 days from issuance and expire without replacement thereafter.
- The Licensor may modify or terminate the invitation programme at any time without notice.
5. Content, Data Sources and Disclaimer
Product data and nutritional values are sourced from Open Food Facts (ODbL 1.0 / CC BY-SA 3.0), map data from OpenStreetMap (ODbL 1.0). This data is provided without warranty and does not replace professional nutritional advice or medical recommendations.
User-generated content (community posts, recipes) is the responsibility of the respective user. The Licensor reserves the right to remove content that violates these terms.
6. Maintenance and Support
The Licensor is solely responsible for maintenance and support of the App. Apple has no obligation whatsoever to provide maintenance or support services.

7. Warranty
The App is provided "as is" without warranty. In the event of a failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App. All other claims are directed exclusively against the Licensor.
8. Liability of the Licensor
The Licensor — not Apple — is responsible for the following claims:
- Product liability claims
- Claims arising from failure to meet statutory or regulatory requirements
- Claims under consumer protection, privacy or similar laws
The Licensor's liability for direct damages is — to the extent permitted by law — limited to the amount paid for the App in the last twelve months. The Licensor is not liable for indirect or consequential damages unless caused by intent or gross negligence.
9. Third-Party Intellectual Property Claims
In the event of any third-party claim that the App infringes intellectual property rights, the Licensor — not Apple — is solely responsible for the investigation, defence, settlement and fulfilment of such claims.
10. Export Control and Compliance
You confirm that you are not located in an embargoed country and are not on any US government list of prohibited parties. The App may not be used for purposes prohibited by US or German export law.
11. Privacy
The handling of your data is described in our Privacy Policy. ExodaFood does not collect personal data; all settings and entries are stored anonymously and locally on your device.
12. Term and Termination
This agreement terminates automatically, without notice from the Licensor, if you breach any of its terms. Upon termination, you must cease all use of the App and delete all copies. You may terminate this agreement at any time by uninstalling the App.
13. Apple as Third-Party Beneficiary
You acknowledge that Apple Inc. and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of these terms, Apple has the right to enforce this agreement against you as a third-party beneficiary.
14. Governing Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction — to the extent permitted by law — is Borken, Germany. Mandatory consumer protection laws of the consumer's country of residence remain unaffected.
15. Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. This agreement constitutes the entire agreement between you and the Licensor regarding the App.
